Terms and Conditions

General

  1. Auto-Sportiva is a company registered in England and Wales with company number 06694348 and with our registered office at Unit 10 Adams Wharf, Branbridges Rd, Tonbridge, Kent, England, United Kingdom, TN12 5HD ("We", "Us", "Our"). Our VAT number is 940045161.
  2. We amend our Terms and Conditions from time to time to reflect any changes in relevant laws and regulatory requirements. To ensure these Terms are up to date, please visit our website at www.Auto-Sportiva.com

Deposits and Payments

  1. The price of the vehicle will be as quoted in our showroom, or otherwise notified to you in writing in the order confirmation ("Price"). We take all reasonable care to ensure that the Price is correct at the time of your order.
  2. Where applicable and noted on the order, the Price includes a deposit of £1000.
  3. The Price includes VAT (where applicable) at the applicable current rate chargeable in the United Kingdom for the time being. However, if the rate of VAT changes between the date of your Order and the date of collection, we will adjust the VAT you pay, unless you have already paid for the Vehicle in full before the change in VAT takes effect.
  4. Please note that all deposits made on site at our premises are non refundable and are put in place to take the vehicle in question off sale for that particular customer.
  5. A £299 admin fee is charged if a finance company is used from outside our official panel of lenders.
  6. Please note You will be required to register and pay for vehicle tax at the point of collection or delivery of the Vehicle.

Part Exchange Vehicles

  1. You must notify us in advance if you have a vehicle you wish to part-exchange and provide us with any information regarding the Part-Exchange Vehicle which we may reasonably request, and bring the Part-Exchange Vehicle to our showroom agreed by us at a time which is convenient to us in order for us to examine it. For a long distance sale we may chose to appraise your part exchange digitally through information that you provide us. E.G- pictures, video. Please ensure this information is accurate as this may effect the price offered for your part exchange once appraised by us.
  2. If we agree to consider your Part-Exchange Vehicle, we may request to examine it at a pre-agreed time and provide you with a valuation. We are not obliged to provide a part-exchange option when selling the Vehicle and our decision to examine and value a Part-Exchange Vehicle, including the valuation we give, is solely at our discretion.
  3. For the avoidance of doubt we are entitled to reject a Part-Exchange Vehicle which is delivered/appraised by us for any reason, including but not limited to circumstances where:
    1. the condition of the Part-Exchange Vehicle has changed since we provided the Part-Exchange valuation or the condition of the vehicle does not match the description given by you;
    2. there is a discrepancy in the recorded mileage of the Part-Exchange Vehicle;
    3. the Part-Exchange Vehicle has been subject to a total loss claim;
    4. any other issue is identified by a HPI check or equivalent vehicle history check on the Part-Exchange Vehicle;
    5. the Part-Exchange Vehicle is not your property to dispose of or you do not have the right to sell it; or
    6. the V5 registration documentation for the Part-Exchange Vehicle is missing, incomplete or is not in your name.
  4. When delivering a Part-Exchange Vehicle to us you must provide:
    1. Both sets of keys to the Part-Exchange Vehicle; and
    2. the V5 registration documentation and any associated documentation (such as service books, MOTS and history etc) for the Part-Exchange Vehicle, without which we will not accept the Part-Exchange Vehicle.

AutoSportiva Advanced Warranty

  1. We would like to highlight that this is not a Third-Party Insurance-based product i.e. no middle man. It is underwritten personally by AutoSportiva; therefore, no call centres and no lengthy wait times.
  2. In short, WE WILL COVER ALL ELECTRICAL AND MECHANICAL COMPONENTS. AutoSportiva Advanced Warranty covers the cost of repair or replacement of ALL mechanical and electrical components that fail due to sudden or unexpected breakdown during normal use.
  3. What parts are not covered:
    1. Consumable/Serviceable Items i.e. Brake Pads/Discs, Air Conditioning Re-Gas, Batteries, Timing Belt Changes
    2. Bodywork i.e. Paintwork Repairs
    3. Glass Cracks/Chips
    4. Damaged Items i.e. interior trims and switches, damaged alloy wheels and tyres
    5. Software Updates – We will only contribute 50% towards these costs.
  4. All We Ask:
    1. Claims must be reported as soon as the fault becomes apparent.
    2. All warranty work must be carried out at a VAT registered workshop, once approval has been granted by AutoSportiva. AutoSportiva will pay up to £100 per hour labour rate.
    3. All vehicles must be serviced and maintained following manufacturer guidelines during your ownership, including maintaining oil and coolant levels.
    4. Vehicles must not be used for any kind of competition/race, be modified, or used for hire (e.g., taxis).
    5. It is the customer’s responsibility to have breakdown cover (e.g., RAC or AA). If the customer does not have breakdown cover, AutoSportiva will contribute £100 towards recovery costs.
    6. Courtesy cars must be collected from our head office.
  5. This warranty does not cover damage caused by neglect, rust/corrosion, and the effects of overheating; fire, lightning, earthquake, explosion, frost, storm, flood, water damage, theft or attempted theft.

Please note this warranty cannot be transferred to anyone else, nor can it be transferred to another vehicle. This warranty is refundable up to 14 days starting from the handover date, providing there has been no claims in this period.

How we use your personal data

  1. We will collect your personal data as part of our Contract with you. We only use your personal data in accordance with the Privacy Policy available on our Site. Please ensure you read the Privacy Policy as it includes important terms which will apply to you.

Events outside of our control

  1. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by any event or event which is beyond our reasonable control (an "Event Outside Our Control").
  2. If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:
    1. we will contact you as soon as reasonably possible to notify you; and
    2. our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects your collection of the Vehicle, we will arrange a new collection date with you after the Event Outside Our Control is over.
  3. You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, we will refund any part of the Price of the vehicle only which you have already paid.

Sales or Return

  1. If we have your vehicle in our possession under our Sale or Return agreement, please ensure it is taxed and insured throughout this time by yourself.
  2. An appraisal of your vehicle will be done and any prep related costs will be discussed to bring your vehicle up to a sellable condition
  3. If you do not collect the Vehicle within 7 days of us notifying you that it is ready for collection then we shall be entitled to terminate our Contract with you by giving you not less than 5 days written notice of our intention to do so.
  4. We must be aware of any finance agreement attached to your vehicle with an up-to-date settlement letter available upon request.

Collection

  1. Collection of the Vehicle shall be completed once you have signed our pro-forma invoice, or other such written confirmation as we may require from time to time, and we have received payment of the Price in cleared funds, including delivery of any Part- Exchange Vehicle we have agreed to accept as part payment of the Price to confirm your acceptance of the Vehicle.
  2. Subject to any finance agreement that you may have in place, ownership of the Vehicle and the right to collect it will pass to you once we have received payment of the Price in cleared funds and have accepted delivery of any Part-Exchange Vehicle we have agreed to accept as part payment of the Price. We own the Vehicle until payment of the Price has been made in full.
  3. If you do not collect the Vehicle within 7 days of us notifying you that it is ready for collection then we shall be entitled to terminate our Contract with you by giving you not less than 5 days written notice of our intention to do so.
  4. Within your handover pack on collection day, you will receive a £500 off loyalty voucher, valid for your next purchase within the next 3 years. Please note this is valid on full price vehicles only and cannot be used in conjunction of any other discount that may have been agreed. This also applies to our 'Bigger Event Voucher' this £500 voucher cannot be used in conjunction with any other discounts.

The Vehicle

  1. The Vehicle may previously have been used as a lease or rental vehicle or have had multiple users. It may also have been imported from another country. We will provide you with any information about the Vehicle on request so if you have any questions about the previous use of the Vehicle or have specific requirements these must be discussed with us before placing your order.
  2. The images and description/specification of the Vehicle on our Site are for illustrative purposes only. Although we have made every effort to display the Vehicle accurately, we cannot guarantee that your Computer or device display accurately reflects the appearance of the Vehicle. Every effort has been made to ensure the accuracy of the information on the advert, however, errors may occur. Please do not rely entirely on this information and check with your sales executive about items that may affect your decision to purchase.
  3. The Vehicle is only provided with the manufacturer's guarantee to the extent that this has not expired. You shall receive a 6 month warranty within the price of the vehicle however we do offer and advise additional extended warranties and guarantee products at additional cost, for further details please ask your salesperson.
  4. Please ensure you are happy with the vehicle condition, specification, mileage, Owners and service history etc as all vehicles are sold as seen and any damage or imperfections pointed out after the point of sale shall not be rectified as it shall be assumed this happened after the point of sale.
  5. Please ensure you, as the buyer, have done your due diligence and are happy with the vehicle specification, mileage, previous ownership, number of keys and service history etc. Please ensure you are also satisfied with the vehicle condition, as all vehicles are sold as seen and any damage or imperfections pointed out after the point of sale shall not be rectified, as it shall be assumed this happened after the point of sale.

Your rights of cancellation, return and refund

  1. Please note that you are entering into a contract with Auto-Sportiva Ltd to purchase your chosen vehicle. You can cancel your Contract with us at any point before you collect the Vehicle by contacting us in writing. However, If you decide to cancel the Contract you shall lose the deposit that you have paid.
  2. We offer a 7 day money back guarantee on our vehicles however there are some exceptions on some sports/luxury vehicles (please see website). Please ask your sales executive the status on your chosen vehicle.
  3. As a consumer, you have legal rights in relation to a Vehicle that is faulty, not of satisfactory quality or not as described. These legal rights are not affected by your right of return and refund. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.
  4. If you wish to exercise your legal rights you should contact us and the sales executive you dealt with and must return the Vehicle to us at the showroom from which you collected it from at your own cost.
  5. If you exercise your legal right to reject the Vehicle and ask for a refund we will:
    1. refund you the Price you paid for the Vehicle. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the Vehicle; and
    2. make any refund due to you as soon as possible and in any event within 14 days after the day on which you return the Vehicle to us.
    3. Please note if you choose to return a vehicle under our 7 day money back scheme or through a long distance sale and you had chosen the vehicle Ceramic Coated and to have you vehicle Gardx detailed by ourselves you shall not be reimbursed for this part of the transaction.

Our liability to you

  1. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into the Contract.
  2. We only supply the Vehicle for domestic and private use. You agree not to use the Vehicle for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business lead.
  3. We do not in any way exclude or limit our liability for:
    1. death or personal injury caused by our negligence.
    2. fraud or fraudulent misrepresentation; or
    3. any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (description, satisfactory quality, fitness for purpose and samples).

Other important terms

  1. We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms.
  2. You may only transfer your rights or your obligations under these Terms to another person if we agree in writing.
  3. Each of the Conditions of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining Conditions will remain in full force and effect.
  4. Please note that these Terms are governed by English law. This means a Contract for the purchase of a Vehicle and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
